TERMS OF SERVICE

1. Who we are
This website, besmartdeals.com, is operated by:

Throughout these terms, "we", "us" and "our" refer to Be Smart Deals, and
"you" refers to the person visiting the site or placing an order.

2. Acceptance
By browsing this website or placing an order you agree to these Terms of
Service. If you do not agree with them, please do not use the site. We may
update these terms at any time; the version published on this page at the
moment you place your order is the one that applies to that order.

3. Who can order
You must be at least 18 years old and legally able to enter into a
contract. We sell to consumers within the European Union.

4. Products and descriptions
We do our best to describe our products and show their colours accurately.
Screens vary, so slight differences in colour are possible. Product images
are illustrative; accessories shown but not listed in the description are
not included.

5. Prices
All prices are shown in euro (or in your local currency where offered) and
include VAT. Shipping is free. We may change prices at any time, but never
after you have placed an order.

Prices shown with a strikethrough compare the current price to our own
previous selling price for that item during the last 30 days.

6. Placing an order
Adding an item to your basket is not a purchase. A contract is formed only
when we send you an order confirmation by email. If an item turns out to
be unavailable, or if a price or description contained an obvious error,
we may cancel your order and refund you in full. We may also refuse or
limit orders that appear fraudulent or that are placed for resale.

7. Payment
We accept the payment methods shown at checkout. Payments are processed by
Shopify Payments and by the relevant payment provider; we never see or
store your full card details.

9. Returns and refunds

10. Legal guarantee
Under EU consumer law, you have a two-year legal guarantee against items
that do not conform to the contract. This guarantee is free of charge and
exists alongside any commercial warranty we may offer.

11. Correct use of the products
Follow the instructions supplied with each product. In particular, charge
electronic products only with the supplied or a compatible certified
charger, do not expose them to water unless the product states otherwise,
and keep small parts away from children. We are not liable for damage
caused by misuse, modification or failure to follow the instructions.

12. Your account
If you create an account, you are responsible for keeping your password
confidential and for activity that happens under your account. Tell us
straight away if you think someone else is using it.

13. Intellectual property
All content on this website — text, images, logos, layout and design — is
owned by Be Smart Deals or used with permission, and may not be copied,
reproduced or used commercially without our written consent.

14. Reviews and content you submit
If you submit a review, comment or image, you confirm it reflects your own
genuine experience and does not infringe anyone's rights, and you give us
permission to publish it. We may remove content that is unlawful,
offensive or misleading.

15. Availability of the site
We aim to keep the site available at all times but cannot guarantee it. We
may suspend or withdraw all or part of the site for maintenance or
technical reasons without notice.

16. Liability
Nothing in these terms limits our liability for death or personal injury
caused by our negligence, for fraud, or for anything else that cannot be
limited under Dutch or EU law. Beyond that, our liability in connection
with an order is limited to the amount you paid for that order.

18. Complaints and dispute resolution
If something goes wrong, email carlosperez@besmartdeals.com and we will do
our best to resolve it. If we cannot reach an agreement, you may submit
your complaint through the European Commission's Online Dispute Resolution
platform: https://ec.europa.eu/consumers/odr

19. Governing law
These terms are governed by the law of the Netherlands. Disputes will be
submitted to the competent court in the Netherlands. As a consumer, you
keep the protection of the mandatory consumer law of the country where you
live, and you may also bring proceedings in the courts of that country.

20. If part of these terms is invalid
If any provision of these terms is found to be unenforceable, the rest of
the terms remain in force.
